AMY'S TREAT: Assisting the Journey of Those Living With Cancer
At Cross Insurance, our goal is to help support as many local non-profit organizations as we can, as we are proud to give back to the community that supports us. Our team of coworkers has decided to participate in Jeans Day, where we choose a local community partner that we will assist each month. Employees interested in participating donate a dollar on Fridays, if they choose to wear jeans, and then a new community recipient is then chosen for the following month.
Our most recent featured community partner for the months of October and November is Amy'sTreat.org. Amy's Treat is a foundation that enriches the journey of those living with cancer, benefiting the patients of the Seacoast Cancer Center of New Hampshire. Amy's Treat offers need based solutions and special outings to individuals whose life has been altered by cancer. Items might include everything from gas cards to dentures to seats at a Patriots game and just about everything in between, because while cancer is not unique, those who battle it are. Request for aid is made through the people that are actively involved in a patient's treatment, the medical personnel who work with them. Amy's Treat remains an all-volunteer non-profit

NH DEPARTMENT OF LABOR CHANGES:
New Rules for Safety Programs
& What Constitutes Employee Vs.
Independent Contractor
Recently, the New Hampshire Department of Labor (DOL) issued new rules as it relates to establishing safety programs and also what constitutes an employee vs. an independent contractor for New Hampshire employers.
The Safety Program rule, which takes effect on January 1, 2013, makes it easier on New Hampshire small businesses to comply as well as lowers the penalty for those who are not in compliance. Tim Weddleton, our Commercial Specialist, would like you to be aware of the summarized changes as follows:
- The number of employees has increased from 10 or more employees to 15 or more employees before an employer must have a written safety program filed with NH DOL
- Safety plans must be updated and filed from a biennially filing on January 1 to every two years.
- Joint safety committees must be established if more than 15 employees which is increased from 5 or more employees.
- Penalties have been lowered from $1,000 to $250.
The employee vs. independent contractor rule (effective 8/6/12) requires a mandatory posting at the place of employment and now uses seven new criteria to establish if a worker is an employee or not.

AFFORDABLE CARE ACT: UPDATE TEMPORARY GUIDANCE ISSUED ON 90-DAY WAITING PERIOD LIMIT
Blaine Horne from our Cross Employee Benefits Department, would like you to be aware that new temporary guidance has been released regarding the 90-day maximum waiting period mandated by the Affordable Care Act (ACA). The ACA stipulates that for plan years beginning on or after Jan. 1, 2014, group health plans and group health insurance issuers may not apply any waiting period that exceeds 90 days.
